Terms of Service

Important: Awaremate is not an emergency service. Do not rely on the Services for emergency response or official warnings.

1. Definitions

  • “Clyptis” means Clyptis Pty Ltd (Queensland, Australia).
  • “Awaremate” means the Awaremate mobile app and related services, websites and APIs (the “Services”).
  • “Community Features” means user-generated features such as community posts, comments, media uploads, and any related reporting/moderation tools.
  • “Content” means information, text, images, video, audio, and other materials made available through the Services, including user-generated content.
  • “User Content” means Content you submit, upload, publish, or otherwise make available through the Services.

2. Agreement to Terms

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

3. Changes to Terms or Services

We may update these Terms or the Services from time to time. If we make material changes, we will update the “LAST UPDATED” date and may provide additional notice. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.

4. Eligibility and account registration

You must be at least 18 years old to use the Services. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

You agree to provide accurate account information and to keep it up to date. You are responsible for all activity under your account, including activity by anyone you allow to access your device or account.

5. Scope of Services and use of Services

The Services provide informational and community-driven map features (including community posts and map layers such as weather, outages, incidents, and transport information). Content may be incomplete, inaccurate, delayed, or out of date.

License: subject to these Terms, Clyptis grants you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal, non-commercial use. All rights not expressly granted are reserved.

You acknowledge that you use the Services at your own risk. We do not guarantee the accuracy, completeness, reliability, or timeliness of any Content.

Third-party and public data: some map layers and features may incorporate information from third parties (including public sources) and/or data made available via third-party APIs. Third-party data may be inaccurate, delayed, incomplete, misleading, or unavailable, and may change without notice.

Availability: the Services may be interrupted, delayed, or unavailable (including due to maintenance, outages, network/connectivity issues, third-party API failures, or factors outside our control). We do not guarantee the Services will be uninterrupted, timely, secure, or error-free.

Not an emergency service: the Services are informational and community-driven. Do not rely on the Services for emergency response or official warnings. For emergencies in Australia, call 000.

6. User obligations and prohibited conduct

You agree not to misuse the Services. Without limitation, you must not:

  • Violate any law, regulation, or third-party rights.
  • Post false, misleading, or deceptive information (including impersonation).
  • Post content that is illegal, hateful, harassing, threatening, sexually explicit, or otherwise harmful.
  • Upload content that infringes intellectual property rights, privacy rights, or other rights of others.
  • Post personal information of others (including addresses, phone numbers, emails, precise locations of private individuals, or any other identifying details) without permission.
  • Use the Services to encourage unsafe behaviour, panic, or vigilantism, including posting hoaxes or false emergency information.
  • Spam, advertise, solicit, or post repetitive or manipulative content intended to game visibility or engagement.
  • Attempt to interfere with, disrupt, or gain unauthorized access to the Services or systems.
  • Reverse engineer, scrape, or extract data from the Services except as permitted by law or with our written consent.
  • Circumvent or attempt to circumvent any safety, moderation, or access controls, including creating new accounts to evade enforcement.

6.1 Community standards (community map and posts)

Community Features are designed for local awareness. When using Community Features, you agree to:

  • Post in good faith and avoid exaggeration or sensationalism.
  • Avoid sharing sensitive or identifying information (including about minors) and avoid posting content that could put someone at risk.
  • Respect others and communicate without harassment, threats, or hate.
  • Only upload media you have the right to share and that complies with these Terms.
  • Avoid content that is likely to cause harm if inaccurate (for example, false outage/incident reports or misleading safety instructions).

6.2 Moderation, reporting, and enforcement

We may (but are not obligated to) monitor, review, remove, restrict visibility of, or disable access to Content or accounts. Moderation may be performed by people, automated systems, or a combination. Automated systems can make mistakes.

We may take enforcement actions including removing Content, limiting features, warning users, suspending accounts, or terminating accounts for violations, suspected misuse, or to protect the Services, users, or the public.

Reporting: if you believe Content violates these Terms or is unsafe, use in-app reporting tools (if available) or contact us via Support. We may request additional information to investigate.

Appeals: if you believe enforcement was applied in error, you may contact us via Support. We may not be able to restore Content (for example, if required for safety or legal reasons).

7. User Content

You retain ownership of your User Content. By submitting User Content, you grant Clyptis a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify (for formatting/compatibility), distribute, display, and perform your User Content for the purpose of operating, improving, and promoting the Services.

This license includes making your User Content available to other users (including publicly, where applicable), enabling sharing features, creating backups, and using your User Content for safety, moderation, and enforcement. To the extent permitted by law, you consent to acts or omissions that might otherwise infringe any moral rights you may have in your User Content.

You represent that you have all rights necessary to grant this license and that your User Content complies with these Terms.

Public visibility: some User Content (including the location attached to a post) may be visible to other users. Do not share information you do not want to be public.

Removal: we may remove or restrict visibility of User Content at any time, including if we believe it violates these Terms, is unsafe, or is required by law.

8. Intellectual property

The Services (excluding User Content) are owned by Clyptis and its licensors and are protected by intellectual property laws. You may not use our trademarks, logos, or branding without our written permission.

9. Subscriptions (AwarePlus)

The Services may offer optional paid subscriptions (such as AwarePlus). Purchases and billing are handled by Apple App Store or Google Play (or their authorized processors). Subscription terms (including pricing, renewal, cancellation, and refunds) are subject to the applicable store’s policies and any in-app disclosures.

Unless otherwise disclosed in-app, subscriptions are generally auto-renewing until cancelled. You can manage or cancel subscriptions in your Apple/Google account settings. Refunds (if any) are handled by the applicable store, not by Clyptis.

10. Termination

We may suspend or terminate your access to the Services at any time if we reasonably believe you have violated these Terms or if necessary to protect the Services, users, or third parties. You may stop using the Services at any time. Account deletion instructions are available at Account & Data Deletion.

11. Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Content (including Community Features) may be provided by other users or third parties, and may be incomplete, inaccurate, delayed, misleading, or unsafe. Clyptis does not endorse User Content and is not responsible for User Content. You are responsible for your use of the Services and for evaluating Content before relying on it.

No reliance for critical decisions: to the maximum extent permitted by law, you agree not to rely on the Services for decisions where incorrect, delayed, or unavailable information could lead to injury, death, property damage, or other harm. Always use official sources, your own judgement, and common sense, and maintain alternative means of obtaining information.

12. Limitation of liability

To the maximum extent permitted by law, Clyptis and its directors, officers, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, goodwill, or other intangible losses arising out of or relating to your use of the Services.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law or other applicable laws that cannot be excluded, restricted, or modified.

13. Indemnification

You agree to indemnify and hold harmless Clyptis from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to your use of the Services or your violation of these Terms.

14. Third-party services, links, and content

The Services may include third-party services or links. We do not control and are not responsible for third-party services. Your use of third-party services is at your own risk and subject to their terms and policies.

15. Governing law and dispute resolution

a. Governing law: these Terms are governed by the laws of the State of Queensland, Australia, without giving effect to choice of law rules.

b. Jurisdiction: you agree that the courts of Queensland, Australia have exclusive jurisdiction to settle any dispute arising out of or relating to these Terms or the Services.

c. Informal resolution: before filing a claim, you agree to attempt to resolve disputes informally by contacting us via Support. If a dispute is not resolved within 60 days, either party may commence proceedings.

d. No class actions: you and Clyptis agree that claims may be brought only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

16. No connection to emergency services

THE SERVICES ARE NOT INTENDED FOR, AND MAY NOT BE USED TO, CONTACT OR COMMUNICATE WITH ANY EMERGENCY SERVICES PERSONNEL OR PUBLIC SAFETY ANSWERING POINTS (E.G., POLICE, FIRE DEPARTMENTS, OR HOSPITALS). YOU ARE SOLELY RESPONSIBLE FOR OBTAINING AND MAINTAINING ACCESS TO TRADITIONAL EMERGENCY SERVICES (IN AUSTRALIA, CALL 000).
